By downloading, installing, accessing, or using the SusAI mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, do not use the App.
These Terms constitute a legally binding agreement between you ("User," "you," or "your") and SusAI ("Company," "we," "us," or "our"). We reserve the right to modify these Terms at any time. Continued use of the App after any modifications constitutes acceptance of the updated Terms.
SusAI is an AI-powered behavioral analysis application that uses computer vision and audio processing to analyze nonverbal communication cues. The App captures video frames and audio recordings with your explicit consent, transmits them to third-party AI services via our secure backend servers, and provides analysis results including truth scores and behavioral breakdowns.
IMPORTANT — ENTERTAINMENT ONLY: The App is designed strictly for entertainment, curiosity, and educational purposes. SusAI is NOT a scientifically validated lie detector, polygraph, forensic tool, medical device, or diagnostic instrument. Analysis results are AI-generated interpretations of visual and audio cues loosely inspired by behavioral psychology concepts. Results are NOT deterministic, NOT guaranteed to be accurate, and MUST NOT be relied upon for any consequential decision-making.
YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT SUSAI'S ANALYSIS RESULTS DO NOT CONSTITUTE FACT, TRUTH, OR EVIDENCE OF ANY KIND. ANY RELIANCE YOU PLACE ON SUCH RESULTS IS STRICTLY AT YOUR OWN RISK.
You must be at least 13 years of age to use this App. If you are between the ages of 13 and 18, you may only use the App with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms.
By using the App, you represent and warrant that you meet the applicable age requirements and have the legal capacity to enter into these Terms.
The App relies on third-party artificial intelligence services to perform its analysis. By using the App and consenting to data sharing during onboarding, you acknowledge and agree to the following:

The App requires access to your device's camera and microphone to function. Before your first scan, the App will present a data consent disclosure which you must accept before any data is captured or transmitted. By granting camera and microphone permissions and accepting the data consent disclosure, you acknowledge and agree that:
WE ARE NOT RESPONSIBLE FOR ANY LEGAL CONSEQUENCES, CLAIMS, DAMAGES, OR PENALTIES RESULTING FROM YOUR FAILURE TO OBTAIN PROPER CONSENT BEFORE RECORDING OR FROM YOUR USE OF THE APP IN VIOLATION OF APPLICABLE RECORDING LAWS.
You agree to use the App only for lawful purposes and in accordance with these Terms. You agree NOT to:
Violation of these acceptable use terms may result in immediate termination of your access to the App without refund.
YOU EXPRESSLY ACKNOWLEDGE AND ASSUME ALL RISKS ASSOCIATED WITH USING THE APP, INCLUDING BUT NOT LIMITED TO:
You agree that you are solely responsible for any consequences that arise from your use of the App and your interpretation of analysis results. SusAI shall bear no responsibility for any decisions made, actions taken, or consequences suffered based on analysis results.
SusAI offers both free and premium subscription tiers:
Subscription payments are processed exclusively through Apple's App Store. All billing, refunds, and cancellation policies are governed by Apple's terms. We do not directly process payments or have access to your payment information.
Prices are subject to change with reasonable notice. Subscription renewals occur automatically unless canceled at least 24 hours before the end of the current billing period. You may manage your subscription and turn off auto-renewal in your Apple ID account settings.
All content, features, functionality, design, graphics, trademarks, service marks, algorithms, and AI prompts displayed in or underlying the App are owned by or licensed to SusAI and are protected by intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms. This license does not include the right to:
Any recordings, images, audio, or other content captured through the App ("User Content") remain your responsibility. By using the App, you acknowledge that:
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
WE EXPRESSLY DISCLAIM ALL LIABILITY FOR:
IN NO EVENT SHALL SUSAI, ITS OWNERS, DIRECTORS, OFFICERS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, CONTRACTORS, OR AFFILIATES BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, REPUTATION, OR OTHER INTANGIBLE LOSSES, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE), EVEN IF SUSAI HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE APP SHALL NOT EXCEED THE LESSER OF (A) THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) FIFTY DOLLARS ($50 USD).
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IN SUCH JURISDICTIONS, OUR LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.
You agree to indemnify, defend, and hold harmless SusAI and its owners, officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees and legal costs) arising out of or relating to:
We reserve the right to suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Grounds for termination include but are not limited to violation of these Terms, abusive or illegal use of the App, or failure to pay subscription fees.
Upon termination, your right to use the App will immediately cease. You may delete your locally stored data by uninstalling the App.
All provisions of these Terms which by their nature should survive termination shall survive termination, including without limitation ownership provisions, warranty disclaimers, assumption of risk, indemnification, and limitations of liability.
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
Any dispute arising out of or relating to these Terms or the App shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved through negotiation within thirty (30) days, it shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in the State of Delaware.
YOU AGREE THAT ANY ARBITRATION OR LEGAL PROCEEDING SHALL BE CONDUCTED ON AN INDIVIDUAL BASIS AND NOT AS A CLASS ACTION. YOU EXPRESSLY WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION AGAINST SUSAI.
The prevailing party in any arbitration or legal proceeding shall be entitled to recover reasonable attorneys' fees and costs from the non-prevailing party.
The following terms apply to your use of the App when downloaded from the Apple App Store. These terms are required by Apple and supplement the rest of these Terms:
a) Acknowledgement
You and SusAI acknowledge that these Terms are concluded between you and SusAI only, and not with Apple Inc. ("Apple"). SusAI, not Apple, is solely responsible for the App and its content. These Terms do not provide for usage rules that conflict with the Apple Media Services Terms and Conditions as of the effective date of these Terms.
b) Scope of License
The license granted to you for the App is limited to a non-transferable license to use the App on any Apple-branded products that you own or control and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions, except that the App may be accessed and used by other accounts associated with you via Family Sharing or volume purchasing.
c) Maintenance and Support
SusAI is solely responsible for providing any maintenance and support services with respect to the App, as specified in these Terms or as required under applicable law. You and SusAI acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.
d) Warranty
In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you (if applicable). To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty are SusAI's sole responsibility.
e) Product Claims
You and SusAI acknowledge that SusAI, not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App, including but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.
f) Intellectual Property Claims
You and SusAI acknowledge that, in the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, SusAI, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
g) Legal Compliance
You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
h) Third-Party Beneficiary
You and SusAI acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.
When using the App, you must comply with all applicable third-party terms of agreement. This includes but is not limited to:
You are solely responsible for any charges from your wireless carrier or internet service provider incurred while using the App.
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and SusAI regarding the use of the App and supersede all prior or contemporaneous agreements, representations, warranties, and understandings, whether written or oral, regarding the App.
We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by updating the "Effective Date" at the top and, where practicable, providing notice through the App.
Your continued use of the App following the posting of revised Terms constitutes your acceptance of the changes. If you do not agree to the new Terms, you must stop using the App and uninstall it from your device.
